Section 1 – Business identity

This Legal Notice is issued by South Bay JDM (“we,” “us,” or “our”). By browsing South Bayjdm.com or placing an order, you acknowledge that you have read and agree to this notice together with our Terms & Conditions, Privacy Policy, and the other policies published on this website.

Section 2 – Website operator and service providers

South Bayjdm.com is owned and operated by South Bay JDM. All product listings, pricing, customer communications, and order fulfillment are our direct responsibility. We rely on trusted service providers to run the website: card and Apple Pay payments are processed by Stripe, PayPal payments are processed by PayPal, and our hosting, email, and shipping partners process information only as needed to provide their services to us. South Bay JDM never stores full payment card numbers.

South Bay JDM is an independent business. We are not a franchise, subsidiary, or authorized dealer of any vehicle manufacturer or original equipment manufacturer (OEM).

What we do

• We sell used and refurbished JDM engines, transmissions, front clips and nose cuts, Korean car parts, and accessories, most of them imported from Japan.
• We ship orders to addresses within the United States and offer local pickup from our warehouse in San Jose, California.
• We offer local installation of engines and transmissions by South Bay JDM technicians, under the terms provided for that service.

Section 3 – Products sold and condition

Unless a product listing states otherwise, every item we sell is a used, pre-owned automotive component removed from a vehicle previously driven in Japan or elsewhere. Some listings are marked as refurbished or remanufactured; the condition shown on each listing applies to that item. Each listing describes the item’s condition, documented mileage where available, and the vehicles it is known to fit. Please read the full listing before you buy.

Every engine we sell passes a multi-point inspection and compression test before it ships. Coverage for eligible engines and transmissions is limited to the terms in our warranty, and returns policy. Where a written limited warranty applies, any implied warranty is limited to the duration of that limited warranty. Items listed as having no warranty are sold “as is” to the fullest extent permitted by law.

Section 4 – Intellectual property

All original content on South Bayjdm.com, including product descriptions, photographs we take or commission, page layouts, graphics, and the South Bay JDM name and logo, belongs to South Bay JDM and is protected by United States copyright and trademark law.

You may view, download, or print pages for your own personal, non-commercial use in evaluating our products. You may not reproduce, republish, distribute, modify, or create derivative works from our content without our prior written permission.

Automated scraping, crawling, or harvesting of product data, prices, or images from South Bayjdm.com using bots, scripts, or similar tools is prohibited without our prior written authorization. Search engines indexing the site in line with our robots.txt file are excepted.

Section 5 – Third-party trademarks

Brand names, vehicle model names, engine codes, and manufacturer names that appear on our website, including Honda, Acura, Toyota, Lexus, Scion, Nissan, Infiniti, Subaru, Mazda, Mitsubishi, Hyundai, Kia, Genesis, Chevrolet, GMC, and Ford, are trademarks of their respective owners.

We use these names only to identify the vehicles a part fits or came from. Their use does not imply any affiliation with, sponsorship by, or endorsement from those manufacturers.

Section 6 – Governing law and jurisdiction

This Legal Notice and all transactions made through South Bayjdm.com are governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

• Venue: any legal action that cannot be resolved under Section 10 must be brought in the Superior Court of California, County of Santa Clara, or the United States District Court for the Northern District of California.
• Sale of goods: the California Commercial Code (California’s version of the Uniform Commercial Code) governs the sale of goods through our website.
• Small claims: nothing in this section prevents either party from bringing an eligible claim in small claims court.
• Severability: if any provision of this notice is found invalid or unenforceable, the remaining provisions stay in full force and effect.

Section 7 – Your consumer rights

We ship throughout the United States, so you are protected by federal consumer protection law and by the consumer protection laws of the state where you live. Where your state’s law gives you rights that cannot be waived by contract, those rights apply in full, regardless of anything to the contrary in this notice or our other policies.

California residents: under California Civil Code Section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

Residents of other states: you may contact the consumer protection division of your state attorney general. We encourage you to contact us first. Most concerns can be resolved quickly and directly.

Section 8 – Limitation of liability

To the fullest extent permitted by law, South Bay JDM’s total liability for any claim arising from the purchase, delivery, installation, or use of a product bought through our website will not exceed the price you paid for that product. This applies regardless of the legal theory of the claim, including contract, tort, negligence, strict liability, or warranty.

We are not liable for incidental, consequential, indirect, special, or punitive damages, including:

• Labor, diagnostic, removal, or installation costs
• Towing, rental vehicle, storage, or transportation costs
• Lost wages, lost profits, or loss of use of a vehicle
• Damage to other vehicle components caused by a part after installation

Some states do not allow the exclusion or limitation of incidental or consequential damages. In those states, our liability is limited to the maximum extent the law allows.

Section 9 – Copyright (DMCA) notices

We respect the intellectual property rights of others and respond to notices under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. If you believe content on South Bayjdm.com infringes a copyright you own or control, send a written notice to our designated agent that includes:

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
2. Identification of the copyrighted work claimed to be infringed
3. Identification of the material on our website you believe is infringing, with enough detail for us to locate it (such as the page URL)
4. Your name, mailing address, telephone number, and email address
5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf

Submitting a notice that contains materially false information may make you liable for damages, costs, and attorney’s fees under 17 U.S.C. § 512(f).

Section 10 – Dispute resolution

We want to resolve every concern quickly and fairly. Before starting any formal proceeding, please follow these steps:

1. Contact us first. Email southbayjdmmotors@gmail.com or call (669) 230-3198 with your order number and a clear description of the issue. We respond within 1–2 business days.
2. Good-faith review. We will review your concern, may ask for supporting documents such as photos or a mechanic’s report, and work with you toward a fair outcome under our published policies.
3. 30-day negotiation. If the first contact does not resolve the matter, both parties agree to negotiate in good faith for at least 30 days before taking formal legal action.
4. Legal proceedings. If negotiation fails, either party may bring a claim in the courts listed in Section 6.

Section 11 – Privacy and cookies

How we collect, use, and protect personal information is explained in our Privacy Policy, which forms part of this notice. Our Cookie Policy explains the cookies used on this website, and residents of California and other states can use our Do Not Sell or Share My Personal Information page to exercise their opt-out rights.
